These Terms of Service (“Terms”) govern your access to and use of the Reklamedia website and software services (the “Service”). By accessing or using the Service, you agree to these Terms.

This document is provided for general informational purposes and is not legal advice.

1) Accounts

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must provide accurate and complete information when creating an account.
  • We may suspend accounts for abuse, fraud, or violations of these Terms.

2) Plans, billing, and upgrades

  • The Service may offer subscription plans and usage limits.
  • If Stripe is enabled, payments are processed by Stripe under their terms.
  • Taxes may apply depending on your location.
  • We may change plan pricing/features with reasonable notice.

3) Acceptable use

Your use of the Service is governed by our Acceptable Use Policy, which forms part of these Terms. In summary, you agree not to:

  • Use the Service for unlawful activities
  • Upload content you do not have rights to use
  • Attempt to bypass security, rate limits, or access controls
  • Reverse engineer or interfere with the Service

4) Content and ownership

  • You retain rights to your content.
  • You grant us a limited license to process your content to provide the Service (e.g., generating outputs).
  • You are responsible for ensuring your content complies with applicable laws and third‑party rights.

4a) Your representations about people shown in your content

This one matters more than the rest, because the Service turns a photograph into an advertisement.

You represent and warrant that:

  • (a) you own or have all rights necessary to upload the content you submit;
  • (b) where that content contains the name, image, likeness, voice, or other identifiable attributes of any individual — including yourself — you have obtained every right, release, and consent required under applicable law from that individual (or from their parent or legal guardian if they are under 18), for use with the Service, including the generation, commercial use, and publication of AI‑generated outputs;
  • (c) your use of outputs complies with applicable law, including any legally required disclosure that the content is AI‑generated in the places you publish it.

You are the publisher of anything you generate. We do not review, approve, or legally clear your content, and nothing in the Service should be read as us doing so.

We may ask you to confirm (b) in the product before you generate. That confirmation is recorded with the exact wording shown to you, the time, and the network address it came from.

4b) Outputs

  • We make no representation that outputs will not infringe the rights of a third party. You assume all risk for your use of them.
  • Outputs are marked as AI‑generated where we are able to do so. Where the law requires a visible label on published content — for example, EU rules on realistic synthetic media — that duty falls on you as the one publishing it.
  • The upstream models we route to may refuse an image or a prompt, including images containing real human faces. That is a property of the model, not a defect in the Service, and refused generations are refunded.

4c) Reporting and removal

If you believe content generated or shared through the Service uses your likeness without permission, or is otherwise unlawful, contact legal@advideolab.com. We remove content and disable share links on credible notice, and we act on reports of non‑consensual intimate imagery within 48 hours. We may suspend or terminate accounts that repeatedly violate these Terms or the Acceptable Use Policy.

5) Availability and changes

We may modify, suspend, or discontinue parts of the Service at any time. We aim to keep the Service available but do not guarantee uninterrupted operation.

6) Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non‑infringement.

7) Limitation of liability

To the maximum extent permitted by law, Reklamedia will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill.

8) Indemnity

You agree to indemnify, defend, and hold us harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising out of or related to:

  • content you uploaded without the rights, releases, or consents required by section 4a;
  • your use or publication of outputs;
  • your violation of these Terms or the Acceptable Use Policy; or
  • your violation of any law or of any third party's publicity, privacy, data‑protection, or intellectual‑property rights.

9) Governing law

These Terms are governed by the laws of Norway, without regard to conflict of laws rules. Disputes will be resolved in the competent courts in Norway, unless mandatory consumer rules apply.
